What’s The Next Step After My Spouse Responds?

If your spouse has responded and your divorce is contested, several things will happen.

First, your lawyer will file a Request for Judicial Intervention, or RJI. The RJI must be filed within 45 days from service, and a preliminary conference will be scheduled within 45 days of the RJI being filed.

In the meantime, you and your spouse will both be ordered to complete a Statement of Net Worth, which you will each exchange and file with the court within 10 days of the preliminary conference.

The preliminary conference will put you, your spouse, and your attorneys in a room together with the judge.

Each element of the settlement will be discussed, with areas of agreement noted.

If all areas are resolved at the end of the preliminary conference, your divorce will soon be over.

If areas of contention remain, you’ll both be back in court for additional conferences, hearings, and possibly a trial, later.
