Is Spousal Maintenance Required If We’re Both High Earners?

Maybe not. If you and your spouse are both in good financial condition and the end of the marriage doesn’t leave either of you in a reduced condition, you may not have to worry about support.

On the other hand, if you’re both high earners and one spouse is taking over a large mortgage and custody of minor children or other significant expenses, there may be reason to provide financial contribution to your spouse going forward.

There are many ways to craft spousal maintenance if it’s required, but if you and your spouse agree that in your situation no maintenance is necessary, then your settlement will note that both parties agreed to no maintenance, and you’ll move on to the next item on the agenda.
