What Is The Penalty For Aggravated Vehicular Assault In The Rochester Area?

A Rochester driver charged with Aggravated Vehicular Assault faces a class C felony, which is a very serious crime.

This offense may result in a substantial sentence of imprisonment, high fines, and a permanent criminal record.

When a driver is convicted of Aggravated Vehicular Assault, he or she may be sentenced to a term of incarceration in a New York State prison of up to 15 years.

In the unlikely event that the Court determines a sentence of incarceration is not necessary, it may impose a sentence of up to five years of probation.

The court is permitted to combine a sentence of incarceration with probation so long as the jail term is less than six months.

In place of or in addition to any jail sentence, the defendant may also be required to pay a fine of up to $5,000.

In addition to the fine, there is a mandatory surcharge of $300, a Crime Victim Assistance fee of $25, and a DNA fee of $50.

A conviction for this crime also will result in the driver’s license of the defendant being revoked for a minimum period of six months.

Unlike many defendants convicted of DWI, a defendant convicted of vehicular assault is not eligible for a conditional license to drive for work or school.

If a defendant is granted probation or a conditional discharge, he or she will be required to have an ignition interlock device installed on any vehicle he or she drives once driving privileges are restored.

The offense carries very serious criminal penalties and requires the help of an experienced DWI lawyer. We can provide you with legal help at 585-484-7432.
