A fall on someone else’s property does not automatically make the owner responsible. A claim commonly requires proof that a dangerous condition existed and that the responsible party created it or had actual or constructive notice and a reasonable opportunity to correct it. Duties can depend on possession, control, lease terms and the property involved.
New York’s storm-in-progress doctrine can affect claims involving snow and ice during an ongoing storm. Timing and weather evidence matter. Questions may remain about a pre-existing condition, negligent snow removal or what happened after the storm ended.
Claims involving city or other public property may require a notice of claim within 90 days. Some municipalities also have prior-written-notice laws affecting streets or sidewalks. These issues should be reviewed immediately.
