        Rochester Medicaid Planning FAQs

        Medicaid planning is the process of legally organizing your finances and assets to qualify for Medicaid long-term care benefits while protecting as much of your estate as possible. Nursing home care can quickly deplete a lifetime of savings without proper planning, so Medicaid planning helps preserve your home and assets for your spouse and heirs while navigating the look-back period and spousal impoverishment protections.

        Ideally, planning should begin at least 5 years in advance to work within New York’s 60-month look-back period and any waiting periods required for trusts. That said, it’s never too late — crisis planning strategies like spousal refusal, Medicaid-compliant annuities, and personal service contracts can still protect significant assets even when care is needed immediately.

        New York Medicaid allows applicants to retain certain exempt assets, such as a primary residence (subject to equity limits), one vehicle, personal belongings, and prepaid funeral arrangements, along with a modest amount of countable assets. Community spouses are permitted to retain significantly more under the Community Spousal Resource Allowance. Exact dollar thresholds are updated periodically, so current limits should be confirmed with an attorney.

        A Medicaid Asset Protection Trust (MAPT), or income-only trust, is an irrevocable trust that removes assets like your home or savings from your countable resources for Medicaid purposes once the 5-year look-back period has passed, while potentially allowing you to retain income generated by those assets.

        Spousal refusal allows a community spouse to decline to contribute their own assets or income toward the cost of care for an institutionalized spouse, letting the institutionalized spouse qualify for Medicaid based on their own resources alone. It’s especially useful in crisis situations where there’s no time to transfer assets in advance.

        Gifts or transfers for less than fair market value within the 5-year look-back period can trigger a penalty period of Medicaid ineligibility, calculated based on the transferred amount and the regional cost of care. Certain transfers, such as those to a spouse or a qualifying caregiver child, are exempt from penalty.
