Community spouses are permitted to retain significantly more under the Community Spousal Resource Allowance. It’s especially useful in crisis situations where there’s no time to transfer assets in advance.
Gifts or transfers for less than fair market value within the 5-year look-back period can trigger a penalty period of Medicaid ineligibility, calculated based on the transferred amount and the regional cost of care. Certain transfers, such as those to a spouse or a qualifying caregiver child, are exempt from penalty.
