        4 Easy Steps to Prepare Your Will Without Leaving Your Home or Car

        For your safety, we are offering remote or drive-up no-contact document signing during the COVID-19 crisis. We are available by phone or email at any time to answer your questions. These are the easy steps to have your will, power of attorney and health care proxy/living will prepared:

        Fill Out the Form

        Complete the Will Information Sheet (“WIS”) or call 716-542-5444 and request that the WIS be mailed to you.

        Return the Form

        Return the WIS to us either electronically via online form, by scanned email, fax 716-542-4090 or by mail to POB 31, Akron, NY 14001.

        Schedule an Appointment

        When we receive your WIS, we will call you or email you to schedule an initial telephone conference.

        Get Your Will

        During the telephone conference, we will advise you when the  documents will be mailed to you and the total fees which can be paid by check or any credit card at WNY-Lawyers.com.

        Remote signing by Facetime, Skype, or other teleconferencing service.

        A. You must affirmatively represent that you are physically situated in the State of New York.

        B. You must transmit by fax or electronic means a legible copy of the signed document directly to us on the same date you signed it.

        C. Mail the signed documents to our Akron office within seven days.

        D. We will mail a copy of your will and the original notarized power of attorney and health care proxy to you

        Remote no-contact signing in your car if you do not have access to Skype, Facetime, or other teleconferencing service:

        A. Drive to one of our offices at the appointment time and stay in your car.
        For an additional charge, we can drive to your home.

        B. Call our cell phone number and we will drive or walk up alongside your car.

        C. We will speak via cell phones and observe the signing through the car windows.

        D. Deposit the documents in our mailbox.

        E. We will mail a copy of your will and the original notarized power if attorney and health care proxy to you.

        Power Of Attorney Lawyer in Rochester, NYIn order to avoid expensive and time-consuming guardianship proceedings, you will need a properly prepared New York statutory power of attorney.

        The New York Power of Attorney will save you and your family thousands of dollars and expedite the handling of your financial affairs in the event of mental or physical disability.

        The signing of a durable power of attorney will allow another person or group of people to act on your behalf to any amount of specific acts.

        If you were to become incompetent due to an illness or old age, having a power of attorney will save you a ton of money because you won’t have to pay for a guardianship or trust.

        There are two types of power of attorney:

        General Power of Attorney

        The “general power of attorney” goes into effect as soon as it is signed notarized and initialed.

        Springing Power of Attorney

        The “springing power of attorney” is for those who are hesitant to grant a power of attorney while they are still able to manage their own affairs.

        The springing power of attorney takes effect at a specified future time or upon the occurrence of a specified contingency, such as the signing of a written statement by a physician or licensed psychologist or psychiatrist certifying that you are suffering from diminished capacity that precludes you from conducting your own affairs in a competent manner.

        You can grant to your agent the power over some or all of the following transactions:
        • Real estate
        • Bonds, shares and commodities
        • Personal property
        • Benefits from military service
        • Lawsuits
        • Records, reports and statements

        A power of attorney is not a substitute for a will because it automatically terminates upon your death.

        Your power of attorney should be prepared by an experienced Power of Attorney lawyer to ensure that:
        1. Modifications are made to enable the agent to do Medicaid (see Medicaid, Medicare & Nursing Home Planning) and estate planning (see Estate Planning,). For example, the agent may have to sign a life estate deed
        2. It is properly signed, initialed, dated witnessed and notarized.
        3. You receive the correct advice on how to best utilize it , in addition to your living trust, health care proxy and living will (see Advance Health Care Directives)
        4. You appoint the correct agents who will not abuse their power.
        5. It is properly prepared so as to not invalidate it. A slight inaccuracy in the document or in the execution of the document may result in third parties, such as banks not accepting it.
        6. It is properly stored or recorded, if necessary, with the County Clerk.
