Petit Larceny is a class A misdemeanor in the Rochester area.

Class A misdemeanors are the highest level of misdemeanor in New York State and only one level below a felony offense.

Misdemeanors are crimes, and a conviction would result in the defendant having a criminal record.

For a first time Petit Larceny offender, this crime carries a maximum possible jail sentence of one year.

A sentence of up to three years of probation is also possible.

If the court chooses to impose a jail sentence of 60 days or less, the defendant may be sentenced to a period of probation after his or her release from jail.

In addition to – or in place of – a possible jail sentence or probation, someone convicted of Petit Larceny may be fined.

As the court’s option, this fine may be up to $1,000 or up to double the amount gained from the theft.

This means that for larger thefts, the court has the option of issuing a fine larger than the $1,000 limit normally seen for class A misdemeanors.

Almost all Petit Larceny cases also result in the court requiring the defendant to pay full restitution to the victim of the theft.

By law, payment of restitution to the victim occurs before payment of any fine to the court if the defendant cannot afford to pay both immediately.
