All drivers convicted in a Rochester area court of Driving While Intoxicated, Driving with a Blood Alcohol Content of .08% or Greater, or Aggravated Driving While Intoxicated will be required to have an ignition interlock device placed on their vehicle to continue driving.
If the driver is still required to have an ignition interlock device in place after completing the other terms of his or her driver’s license revocation, the Department of Motor Vehicles will issue that driver a post-revocation conditional driver’s license.
This driver’s license will note on its face that the driver is required to have an ignition interlock device on any vehicle he or she is driving.
Whether a driver is allowed to hold a post-revocation conditional driver’s license is determined by the Department of Motor Vehicles.
Even if the driver is issued this license, the DMV retains the authority to revoke the driver’s license.
The regulations of the DMV state that a post-revocation conditional driver’s license will be revoked under any of the following circumstances:
• The driver fails to comply with the terms of his or her probation or conditional discharge as set forth by the court;
• The driver is convicted of any traffic offense other than one involving parking, stopping or standing;
• The driver is convicted of any alcohol or drug related offense, misdemeanor or felony; or
• The driver fails to install or maintain a court ordered ignition interlock device.
Drivers in this situation should note that the traffic offense that may form a basis for revocation does not have to involve alcohol or drugs.
