Most first time offenders convicted of drinking and driving in the Rochester area are eligible to enroll in the Drinking Driver Program (DDP) and obtain a conditional driver’s license to drive for work, school, medical care and certain other essential activities.
To obtain a conditional driver’s license, a defendant must enroll in the DDP.
Whether a convicted driver is eligible to participate in the DDP is determined by the Department of Motor Vehicles.
Following a conviction for a drinking and driving offense, the court will report the conviction to the Department of Motor Vehicles.
Once the DMV has determined whether the driver is eligible for the DDP, it will send a letter to the driver explaining what steps must be taken to apply for the DDP.
This letter and any other necessary documentation should be taken to the local branch of the DMV, where the defendant can apply for the DDP and should receive information such as where the DDP classes are held.
A driver who does not receive this letter from the DMV within 18 days of sentencing should call a local DMV office for further instructions.
There is a $75 fee payable to the DMV when applying for the DDP.
There will also be a $225 fee to attend the DDP.
A driver who chooses not to attend the DDP is not eligible for any form of conditional driver’s license while his or her full driving privileges are suspended or revoked.
