What proof do I need for a NY medical malpractice case?
In order to win a medical malpractice case, you will need to prove that: you were under the care of a physician; in the course of advising you, diagnosing you, or treating you, the physician failed to act as a doctor in the specialty should act; and as a result you were injured, became ill, or a condition or injury worsened.

Medical malpractice occurs when a doctor, healthcare professional, hospital, or other healthcare facility fails to care for someone in accordance with accepted standards of the medical profession, and the person is injured, becomes ill, or their condition worsens as a result.

Under the doctrine of res ipsa loquitur (“the thing speaks for itself”), certain injuries could not have occurred without negligence, such as an incorrect organ being removed, the wrong limb being amputated, or a clamp left inside the body. In these cases, your attorney instead shows the type of accident doesn’t occur without negligence, that the equipment or conduct was under the physician’s control, and that you didn’t contribute to your own injury.
