Following a conviction for drinking and driving in the Rochester area, a driver may be required to attend the Drinking Driver Program (DDP) by the court.
For defendants who are eligible to obtain a conditional driver’s license following a DWI conviction, attendance at the DDP is mandatory before the DMV will issue the conditional license.
A driver attending the DDP will be evaluated for alcohol or substance abuse and may be referred for additional treatment.
Upon entering the DDP, drivers are required to take the RIASI (Research Institute on Addiction Self Inventory) test, which is used to assess the likelihood of the driver re-offending.
A high score on this test will result in the driver being referred to an outside alcohol treatment provider – who must either be approved by the NYS Office of Alcoholism and Substance Abuse Services or professionally licensed by the NYS Office of Education – for additional evaluation and possible treatment.
Drivers will also be referred by the DDP for additional evaluation and possible treatment if they have two or more alcohol or drug-related driving incidents in the past ten years, attend a DDP class under the influence of alcohol or drugs, or are arrested for an alcohol or drug-related driving offense while attending the DDP.
A driver who self-reports an alcohol or substance abuse problem to the DDP will also be referred for additional evaluation and treatment.
A driver who is referred by additional evaluation or is required to undergo additional treatment but fails to do so will be considered non-compliant with the requirements of the DDP program.
As a result, his or her conditional driver’s license may be revoked by the Department of Motor Vehicles.
