I Recently Moved To Rochester From Another State. When Can I Divorce?

After moving to Rochester from another state, you can divorce as soon as you meet New York’s residency requirements.

These can be slightly confusing, but roughly speaking, the residency requirements are two-tiered, depending on whether you and your spouse have ties to New York.

If you are newly moved to the state and did not live here as a married couple, were not married here, and the cause of your divorce did not occur in New York, you must be a resident for two years before you can file for divorce in Rochester.

If you married here, resided here as a married couple, or the cause of your divorce occurred here, you will have to be a resident for a period of one year.

Each marriage is unique and your circumstances may or may not fit comfortably within these definitions.
