Criminal Possession of a Controlled Substance in the Fourth Degree (NY PL 220.09) is a class C felony that’s charged by Rochester prosecutors when you are caught in possession of a given amount of a controlled substance.
An eighth of an ounce of a preparation containing a narcotic drug, or half an ounce of a mixture containing methamphetamine are enough to trigger charges under the statute, so it’s not as though you have to be in possession of large amounts of most drugs to end up charged under NY PL 220.09.
Instead of a minimum of one year, you’ll be sentenced to three and a half to fifteen years if you’re found guilty.
