When someone comes to see me as a Rochester Divorce Attorney asking about spousal support, I tell them New York law contains a formula which will determine spousal support. Essentially, that law is a calculator. The wife’s income and the husband’s income are entered, and a calculation within the law will determine whether or not spousal support is warranted. When deciding the issue of long-term spousal, courts will look at that calculator along with many, many other factors. As a general rule, if the two parties earn approximately the same amount, there’s much less chance that one will be ordered to pay spousal support to the other. Most often, spousal support is ordered when there is a large discrepancy between the incomes of husband and a wife.
