Female Genital Mutilation (NY PL 130.85) is a cultural a
nd religious practice still employed in many parts of the world.
Because of the age of those subjected to the procedure, New York has chosen to criminalize the act.
The statute prohibits the following conduct:
- Performing Female Genital Mutilation on a person under the age of 18
- Consenting, as the parent or guardian of a person under the age of 18, to allowing Female Genital Mutilation to be performed on the child.
Female Genital Mutilation is a Class E felony and conviction can lead to a sentence of up to four years in prison.
This crime is considered serious and even heinous by Rochester prosecutors, and is treated as a sex crime.
