In the United States, 1 out of every 8 people are killed in a traffic accident that involves a truck or semi, and it’s usually the driver or passengers of the vehicles struck by the trucks – not the semi truck drivers themselves.
There are few things more dangerous to passengers in cars than a fully loaded tractor trailer rolling down the road at speeds in excess of 60 mph. When you combine that with sleepy, over-driven truck drivers it makes the situation deadly at times. Oftentimes, the pressure to move cargo and excel at their job causes truck drivers to work 16-hour days. Recently, we saw a study that showed 20 percent of truck drivers admitted to falling asleep at the wheel. It should come as no surprise then when innocent and responsible drivers are killed by these massive trucks, overexertion often plays a large role.

A commercial-truck collision may involve the driver, motor carrier, trailer owner, maintenance provider, broker, shipper or another business. Each may control different records. Early investigation can help preserve electronic logs, dispatch communications, inspection records, onboard data and video.
Federal motor-carrier rules address hours of service, electronic logging devices, vehicle inspection and driver-qualification files. A rule violation does not decide a civil case by itself, but the records may help explain fatigue, maintenance, hiring or supervision issues.
Responsibility depends on control and fault. A driver may be responsible for unsafe operation, while a carrier may face claims tied to its own conduct or the driver’s work. Maintenance companies may be involved when faulty service contributed. Brokers and shippers are not automatically liable; their actual role must be examined.
An evidence-preservation letter can identify records that should not be destroyed under ordinary retention schedules. Police materials, photographs, medical records and witness information should also be collected.
